Old great artists <em>litigate</em>?</p>
<p>I missed the news about the <strong>Apple-HTC Patent Lawsuit</strong> (<strong>Google Android</strong>) until tonight when I found out <a href="http://txfx.net/2010/03/04/john-gruber-on-the-apple-htc-patent-lawsuit/">about it on Mark Jaquith&#8217;s blog</a>.</p>
<p>I&#8217;m happy that these cards of Apple are finally on the table. I think Apple&#8217;s Multi-touch related patents have been hanging over the heads of other hardware and software developers.</p>
<p>I don&#8217;t think I&#8217;ve ever found myself agreeing with John Gruber more:</p>
<blockquote><p>&#8220;No doubt some of you are nodding your heads and see this as justification for Apple’s suit. But life isn’t fair. Great ideas make the world better. Apple can rightly expect to benefit greatly from the ideas embodied by the iPhone, but they can’t expect to reap <em>all</em> of the benefits from those ideas.</p>
<p>That’s the nature of implementing insanely great ideas. The bar has been raised, and, yes, Apple did most of the lifting. That’s how it goes.&#8221;</p>

<p>Right now people are in their venting phase. What comes next?</p>
<p>Is there an effective <strong>protest</strong> against the Apple-HTC patent lawsuit? Particularly something that Apple customers should do?</p>
<p>I can&#8217;t see enough people caring, particularly on the eve of the iPad.</p>
<p>May 5th quotes from the comments:</p>
<p><a href="http://ian.mckellar.org/">Ian</a> wrote &#8220;I think Apple customers should use one finger at a time in protest.&#8221;</p>
<p><a href="http://txfx.net/">Mark</a> wrote &#8220;Apple has to operate in the system as it exists.&#8221;</p>

<p>I don&#8217;t remember who gave me the link to <a href="http://www.christophniemann.com/">Christoph Niemann’s</a> <a href="http://niemann.blogs.nytimes.com/2009/09/14/good-night-and-tough-luck/">brilliant illustrations</a> in <a href="http://niemann.blogs.nytimes.com/2009/09/14/good-night-and-tough-luck/">&#8220;Good Night and Tough Luck&#8221;</a>, but often at night this image comes to mind.</p>
<p>It expresses so well my nightly ritual of trying to find a mutually comfortable place for my bottom arm.</p>
<p>My old standard was trying to weave it under her pillow above her head. The trouble with that move was the cold wall my wrist invariably is up against.</p>
<p>The challenges are currently heightened by <a href="http://julessilver.com/">my wife</a> being pregnant.  The slightest variation to her pillow position affects her comfort.</p>
<p>Most recently I&#8217;ve been straight arming it at my side, but my arm tends to fall asleep, accelerating my turning over to actually fall asleep.</p>
<p>Where do you put the arm under you?</p>

According to his research, a crunch or traditional sit-up generates at least 3,350 newtons (the equivalent of 340 kg) of compressive force on the spine. The U.S. National Institute for Occupational Safety and Health states that anything above 3,300 newtons is unsafe.</p>
<p>So McGill suggests replacing sit-ups with exercises to strengthen the core while not bending the spine: bridges, planks, leg extensions, bird dogs, and “stir the pot.” The bird dog, for instance, simply involves getting on all fours and, while keeping the core muscles tight, extending the opposite arm and leg, then switching limbs. “Stir the pot” is a more complex movement: moving shoulders in a small circle while in a prone push-up position with forearms balanced on an exercise ball.</p>

<p><a href="http://en.wikipedia.org/wiki/Marijuana_Control,_Regulation,_and_Education_Act">California Assembly Bill 390</a> is an act to tax and regulate marijuana in California.</p>
<p>Some of the key messages I got from Judge Grey&#8217;s testimony:</p>
<ul>
<li>Legalizing is not the same thing as condoning. Just as we do not condone smoking cigarettes, we will not condone smoking marijuana.</li>
<li>If legal system is being hard on drugs (marijuana), it&#8217;s being weaker on worst crimes &#8212; limited resources.</li>
<li>Criminal =&gt; enormous profit =&gt; violence. We have to remove the profit, and take the power from these violent monsters. This will save lives.</li>
<li>Lets have it strictly regulated and controlled with no advertising.</li>
<li>Children are the victims of prohibition. &#8220;Dealers don&#8217;t ask for ID.&#8221; Dealers recruit children to deal to other children.</li>
</ul>
<p>His comments on children hits most home for me. I remember as a young teenager having far greater access to marijuana (and far worse drugs) than to alcohol. I don&#8217;t want my son to have to deal with this garbage.</p>
<p>I sincerely hope Bill 390 is successful. The success of their program will be an important lever in the debate for ending prohibition in British Columbia and all of Canada.</p>

&#8220;Founded on March 16, 2002, LEAP is made up of current and former members of the law enforcement and criminal justice communities who are speaking out about the failures of our existing drug policies. Those policies have failed, and continue to fail, to effectively address the problems of drug abuse, especially the problems of juvenile drug use, the problems of addiction, and the problems of crime caused by the existence of a criminal black market in drugs.</p>
<p>Although those who speak publicly for LEAP are people from the law enforcement and criminal justice communities, a large number of our supporting members do not have such experience. You don&#8217;t have to have law enforcement experience to join us.</p>
<p>By continuing to fight the so-called &#8220;War on Drugs&#8221;, the US government has worsened these problems of society instead of alleviating them. A system of regulation and control of these substances (by the government, replacing the current system of control by the black market) would be a less harmful, less costly, more ethical and more effective public policy.&#8221;</li>

<p>From starting a company with Boris and Co&#8217;s <a href="http://bootuplabs.com/">Bootup Labs</a> to being the area experts for your company, you want three of you.</p>
<p><strong>3 is a magic number</strong>.</p>
<p>I&#8217;ve always just gone with having one backup, but reflecting on it now, I should have two backups in each area.</p>
<p>At first it seems like an incredible amount of redundancy, but someone&#8217;s own focuses and work doesn&#8217;t go away when they have to fill in for you. You need two backups, two people who can step in to carry your load &#8212; each carrying some of your load.</p>
<p>This extends beyond backing you up. This creates a mesh of collaboration,. Having different collaborators (back ups) in different areas leaves no weak links.</p>
<p>Disagreeing about something with your backup? With three there is always a moderator / negotiator / tie breaker.</p>
